⚖️ Supreme Court Ruling Cheshire West
Last week’s Supreme Court ruling has removed the legal framework known as Chestire West, which previously helped identify when someone may be deprived of their liberty and ensured independent safeguards were in place.
At Drive, we believe that every person deserves to live in a place they can truly call home — with freedom, dignity, and the right support around them.
We are concerned that the removal of these safeguards creates uncertainty and risks weakening protections for people, particularly at a time when we continue to see cases of poor practice and abuse — often in larger, institutional settings.
💬 We stand firmly behind our Homes not Hospitals approach:
We will be working alongside other providers and Cymorth Cymru to seek clarity, push for stronger guidance, and ensure that people’s rights remain protected. A joint response to Welsh Government is already underway.
In the meantime, we will continue to follow the Welsh Government Reducing Restrictive Practices Framework and our own policies to uphold the highest standards of care.
